GENERAL TERMS AND CONDITIONS OF RENTAL FOR THE ONYX, BERYL, TOPAZ, OPAL AND GARNET APARTMENTS
1 – GENERAL PROVISIONS The tenant may not, under any circumstances, claim any right to remain on the premises after the expiry of the period initially stipulated in this contract.
2 – RESERVATION AND PAYMENT Reservations can be made either by email to lemanoir.bo@gmail.com or directly on the website https://www.lemanoir-oisans.com/. The reservation becomes effective once the tenant accepts these rental conditions and pays the deposit before the indicated date. The balance of the rental must be paid no later than 10 days before the arrival date.
3 – SECURITY DEPOSIT Upon arrival, a security deposit of €400 to €700 per apartment is required by the owner. It will not be cashed and will be returned to the tenant after the joint move-out inspection, less any deductions for the cost of repairs and replacement of any items and equipment provided. If the security deposit is insufficient, the tenant agrees to pay the difference, based on supporting documents provided by the landlord.
4 – USE OF PREMISES The tenant shall use the rental property peacefully and properly, in accordance with its intended purpose. Upon departure, the tenant agrees to leave the property as clean as it was upon arrival. The rental may not, under any circumstances, benefit third parties. The landlord must provide the property as described and maintain it in good working order.
5 – NUMBER OF OCCUPANTS The number of tenants may not exceed the occupancy capacity indicated in the rental property description. However, an extension may be granted by the owner. In this case, and taking into account the additional costs incurred by the change in the number of occupants, a supplement may be calculated proportionally to the number of people.
6 – INVENTORY AND CONDITION REPORTThe inventory and condition report of the furniture and various equipment will be carried out jointly by the owner at the beginning and end of the stay.
7 – CANCELLATION POLICY
From booking until 15 days prior: No charge
From 14 to 7 days prior: 30%
From 6 days prior to arrival: 100%
8 – EARLY DEPARTURE In the event of early departure by the tenant, not due to force majeure, no refund will be issued, except for the security deposit (see paragraph 3). Force majeure is recognized if the tenant provides proof of serious reasons making the total or partial execution of the rental impossible. In this case, the landlord may refund any sums already paid, corresponding to the pro rata of the unused occupancy period.
9 – INSURANCE The tenant is required to insure the premises entrusted to them or rented. They must therefore check if their primary residence insurance policy includes holiday rental coverage. If not, they should contact their insurer. The landlord may require proof of insurance or, failing that, a sworn statement.
10 – DISPUTES OR COMPLAINTS If the complaint concerns the inventory or the rental description, it must be submitted in writing within seven days of arrival. The landlord and tenant should strive for an amicable resolution. For other disputes, the tenant may, without any time limit, contact a representative body.
